Consumer Data Privacy
We respect your privacy and follow the laws which are committed to protecting it. Some personal information about your order such as name, address and email address for instance are stored on our servers for use with managing your order. In no way will these details be sold or shared with third parties.
All sensitive credit card data is processed using PCI compliant measures. We go above and beyond to make sure your secure data stays private, including processing all transactions over a state of the art SSL-encrypted connection.
Legal
It is your responsibility to know and understand the laws in your area and only purchase products that are legal for you to purchase and possess in your area. It is your responsibility to follow both State and Federal laws as well as any city ordinance type laws that may exist. In no way will Mr Gun Dealer be liable for damages incurred by a consumer violating any law.
Returns
Returns on accessories can be made within 30 days of your item being delivered for a 100% full refund of the purchase price. To be eligible for return, the item must be in new, unused condition and have the original packaging.
Optics can be returned within 30 days of your item being delivered however all optics are subject to a restocking fee of 25%. To be eligible for return, the item must be in new, unused condition and have the original packaging.
Unless there was a mistake and you were shipped the wrong item from what was ordered, ammunition is not eligible for return.
Unless there was a mistake and you were shipped the wrong item from what was ordered, firearms and class 3 NFA items are not eligible for returns once they are transferred into your possession by your receiving dealer. These items are heavily regulated and the chain of custody of these items is of utmost importance to everyone. Once a firearm or NFA item is transferred into the possession of a non licenced ffl dealer the item is considered used, even if the item is unfired. Used firearms have different values than new items, much like the concept of purchasing a new car then driving it off the lot. Please make sure to inspect your firearm or NFA item thoroughly at your receiving FFL dealer before completing the transfer. Once you accept transfer of the item, unless a separate Mr Gun Dealer Firearm Care Plan was purchased, all warranty/return/repair work is between you and the respective manufacturer.
If you notice a problem with your firearm or NFA item before taking possession of said item during the inspection period at your receiving dealer, please do not take possession of the item and contact us right away. If the item is defective or something is not normal with it, we will take it back right away and get you a replacement item or a full refund. If there was a problem with your item due to a manufacturer defect or similar, you will not be liable for any shipping costs or restocking fees in any way.
If during the inspection period at your receiving dealer, before taking possession of a firearm or NFA item, you decide you do not want the item or you are prohibited from taking possession of said item, we will accept a return. Assuming the item is correct and there is nothing wrong with it, we reserve the right to charge up to a 25% restocking fee in these instances.
After placing an order but before the order ships, occasionally there will be times when customers wish to cancel or modify their orders. We are setup to begin fulfilling your order the moment it is placed and very soon after it is placed, the ball starts rolling. Way more so than the average online business, gun stores incur greater handling costs with our products due to the nature of what they are. This makes cancellations extremely difficult for us. After place an order and before your order ships, if you would like to cancel your order, that is acceptable however we reserve the right to charge up to a 15% restocking fee.
To initiate a return on an eligible item, simply call our customer service department at +1 (424) 269-5398 and one of our agents will guide you through the process. We will email you a shipping label so all you have to do is box up the item, slap the label on the box, and drop it off at the nearest pickup location. Shipping charges are non refundable. If the cause of the return is not our fault, the cost of the return shipping label will be deducted from your refund. If for some fluke of a reason you did not get the item you ordered from us, The Gun Dealer will return your items and assume all costs involved in doing so.
Advertising and Pricing
We reserve the right to not sell something that was accidentally mispriced or accidentally listed improperly. This is very rare, however human error has happened before and it will happen again. Please understand we do our best to display accurate information however there are times we make a mistake.
We advertise thousands of product skus and occasionally manufacturers will change the product codes or UPC codes of their products with or without notifying us. The manufacturers may do this for promotional reasons, marketing, or perhaps they just want to make a change. Our software systems are set up to streamline the sale of products in the most efficient manner and you hereby agree and understand this. No matter the case or reason, it is our promise to you, our customer, that you receive the product you ordered from us. If there is ever a discrepancy and you are unsatisfied in this type of extremely rare situation, we will make it right with you.
Stock availability
Stock quantities and prices may change constantly without notice. We reserve the right to cancel and refund an order if we are unable to fulfill it due to a stock quantity mistake.
Shipping times
Listed shipping times are indications of estimated ship times only. Assuming we have legal shipping address information and payment at the time the order is placed, we are extremely accurate in our estimates. Not having a FFL on file for a receiving dealer is the main cause of delayed ship times. If your dealer is not on file at the time you place an order, the estimated ship time will be delayed as we must take the time to obtain your dealers licence hard copy. Reference payment method tab listed on the top of the home page to see estimated shipping times based off select payment methods.
In-store pickup items are treated differently than shipped items. All in-store pickup orders will be fulfilled and ready for pickup within one to seven business days from the order date.
Warranty Issues
Unless otherwise noted as pre-owned or used, all products we sell are new in box from the manufacturer and come complete with all warranties. Unless a The Gun Dealer Firearm Care Plan was purchased at the time of sale, all warranty and repair issues are between the consumer and the manufacturer.
Ammunition purchases
The law requires you to be 18 or older to purchase shotgun shells or rifle ammunition and at least 21 to purchase handgun ammunition. You agree that by purchasing ammunition from The Gun Dealer that you are in accordance with all ammunition laws in your area.
Responsibility
If used not as directed by the manufacturer, some products we sell can cause severe injury or death. By purchasing from The Gun Dealer, you agree that you are responsible for following all safety precautions as recommended by the manufacturer of the item. You also agree to use the products we sell in a safe and legal manner.
The customer is responsible for knowing, understanding, and following all laws in regards to products purchased on this website.

Fraud prevention
For your safety and protection, we reserve the right to request additional details in order to verify your identity in regards to fraud prevention. This may be information such as proof of address and or legal identification.

By engaging thegundealer.us, shopping with us, or sending us emails, we will engage back in the same electronic manner. You fully agree that this form of communication satisfies any and all legal requirements for anything needing to be in writing.
Reviews and comments
Customers may review products and write comments regarding their opinions. The Gun Dealer reserves the right to withhold and or not post any comments that are illegal, obscene, threatening, defamatory, infringing on intellectual property rights, or otherwise not suitable to viewing by the average person of moral character.
If you do choose to write a review or post content on our website, you are hereby granting The Gun Dealer a non exclusive, royalty-free, perpetual, irrevocable, and full sublicensable right to use, reproduce, adapt, publish, translate, and modify said content throughout any media we choose. You are granting a sublicense to use the name that you have submitted in connection with said review. You declare that you own all intellectual rights to the content you post, that the content is true and accurate, and that whatever you post will not cause injury to any person or entity, and that you indemnify The Gun Dealer for any and all claims resulting from content you supply. Any product purchased from The Gun Dealer are made pursuant to a standard shipment contract. This implies that the risk of loss and title of items during transit are passed to you, the customer, upon the delivery carriers acceptance of the shipment. In the event shipping insurance was purchased by the customer, all risk of loss during transit falls back on Mr Gun Dealer and then and only then will The Gun Dealer be liable for the loss of goods.
